Remember Shuanghuan Automobile's Noble, the Chinese minicar that blatantly copies the design of the previous Smart Fortwo? Well, the Noble has made its appearance in several European countries including Greece where Smart's parent company, Daimler, naturally decided to take the importer, 'China Motors', to court in order to block the sale of the car in the Mediterranean country on the basis that infringes its design copyright for the ForTwo. Easy decision, right? Wrong...

China Noble Smart Fortwo Clone - CarscoopBelieve it or not, according to China Motors, a Greek court in Piraeus has just dismissed Daimler's claim on the basis that "an informed buyer would not confuse the Noble with the Smart Fortwo."

The judgment goes on to say that "it is commonly acknowledged that a decision to buy a car should not depend solely on the vehicle's exterior styling, but also on the technical features such as the automobile's engine."

In this aspect, China Motors said that the court took into consideration the fact that the Noble differs significantly in technical specifications from the Smart Fortwo as it is longer (3meters vs 2.5meters), it has two extra seats at the back and it incorporates a front-mounted engine sending power to the front wheels whereas the Fortwo has a rear-mounted engine that drives the rear wheels.

In other words, according to the Piraeus court's reason, Chinese automakers can sell any clone they want in Greece as long as the technical specifications differ from the original product. Yep, we're pretty much convinced by now that for this particular judge, the MacPherson strut and Ellie MacPherson's butt are one in the same...

According to China Motors, the Noble will go on sale in Greece sometime during the second half of the year.

"MacPherson strut and Ellie MacPherson's butt are one in the same" Hahaha, laughed my head off with this one! But seriously, is this decision rational?

I'm in agreement with the court. After all, look how similar the Mercedes S-Class, Lexus LS-series, and Hyundai Genesis appear on the outside. How about all the Japanese cookie-cutter midsize sedans throughout the 80's and 90's? And the old Isuzu Trooper and Mitsubishi Montero. The FJ40 Land Cruiser and Jeep CJ. The Suzuki Samurai, Land Rover Defender, and Mercedes Geländewagen. The Mercedes CLS and Volkswagen CC.

Hey Daimler - imitation is the sincerest form of flattery!

Well one thing is certain, Chinese people are good copiers, and they make it work for them

I wonder if you brake really really hard the car lifts up at the back? like a motorbike doing an endo.

Mercedes simply has to wait until the European crash institute subjects it to the standard NCAP test....and ask in their ads if people reeeeeally wanted to be in a poor facsimile of a better car. Design can be defended as per this court action -- just change it by one millimetre and you're away laughing. The substance of the product though is where the difference is.

I don't like either the Fourtwo or this clone...

But for frigg's sake! At 60 paces away, I doubt you'd see much differences except for the fact that one ripped off the other.

This is not a final decison by the Greek courts but only a simply not acceptance of the temporary court injunction as the trial is later this year.

There is still a long way to go before a final decision by the Greek legal system is final.

Well said! has anyone gone on to Youtube to look at some NCAP tests on cheap chinese cars? Well the reason why they dont get sold in Europe is becasue all the chinese cars fail in safety!
